Book excerpt: Almost unique among the works of Muslim scholars, this book, which for Malikis is THE Risalah, was written for children when the author was 17 years old. The sheer pedagogical audacity of introducing children to what is in effect a complete overview of life and human society escapes most people and most Muslims today. The author commences with usul ad-deen - the roots of the deen - a survey of the vital Muslim worldview, proceeding then through purification and the acts of 'ibadah, the ordinary transactions such as marriage, divorce, buying and selling and so forth, and concluding with chapters of a general and miscellaneous nature. The book is here matched by the outstanding lucidity of the translation which reveals a book written in a narrative descriptive style rather than in a didactic scholarly tone, making it breathtakingly accessible. So significant was the book's authorship and so quickly was it recognised that its author became known as the "Young Malik" and his work became a foundational pillar of the madhhab of the School of Madinah and has endured for a millennium, in use both to teach absolute beginners as intended and as a resource for scholars. This edition presents the translation in parallel with the Arabic text without vowellisation (tashkeel). Ibn Abi Zayd al-Qayrawani (310 AH/922 CE - 386 AH/996 CE) was born in Qayrawan in Tunisia, arguably one of the most important Muslim cities after Makkah and Madinah, which was always famous for learning and in particular for its staunch adherence to the school of the people of Madinah as transmitted by Imam Malik. His life was overshadowed by the Fatimid dynasty, during which he and the other teachers of Qayrawan calmly kept alive the teaching of the Book of Allah and the Sunnah. Among his other well-known works are the massive multi-volume an-Nawadir wa'z-Ziyadat and a mukhtasar-abridgement of the Mudawwanah of which only the Kitab al-Jami', a comprehensive work containing a wide variety of topics, is extant. Aisha Bewley is the translator of a large number of classical works of Islam and Sufism, often in collaboration with Abdalhaqq Bewley, notably The Noble Qur'an - a New Rendering of Its Meanings in English; Muhammad, Messenger of Allah - the translation of Qadi 'Iyad's ash-Shifa'; the Muwatta' of Imam Malik ibn Anas; and Imam an-Nawawi's Riyad as-Salihin.

Book excerpt: Challenging the Secular State examines Muslim efforts to incorporate shari’a (religious law) into modern Indonesia’s legal system from the time of independence in 1945 to the present. The author argues that attempts to formally implement shari’a in Indonesia, the world’s most populous Muslim state, have always been marked by tensions between the political aspirations of proponents and opponents of shari’a and by resistance from the national government. As a result, although pro-shari’a movements have made significant progress in recent years, shari’a remains tightly confined within Indonesia’s secular legal system. The author first places developments in Indonesia within a broad historical and geographic context, offering a provocative analysis of the Ottoman empire’s millet system and thoughtful comparisons of different approaches to pro-shari’a movements in other Muslim countries (Saudi Arabia, Iran, Pakistan). He then describes early aspirations for the formal implementation of shari’a in Indonesia in the context of modern understandings of religious law as conflicting with the idea of the nation-state. Later chapters explore the efforts of Islamic parties in Indonesia to include shari’a in national law. Salim offers a detailed analysis of debates over the constitution and possible amendments to it concerning the obligation of Indonesian Muslims to follow Islamic law. A study of the Zakat Law illustrates the complicated relationship between the religious duties of Muslim citizens and the nonreligious character of the modern nation-state. Chapters look at how Islamization has deepened with the enactment of the Zakat Law and demonstrate the incongruities that have emerged from its implementation. The efforts of local Muslims to apply shari’a in particular regions are also discussed. Attempts at the Islamization of laws in Aceh are especially significant because it is the only province in Indonesia that has been allowed to move toward a shari’a-based system. The book concludes with a review of the profound conflicts and tensions found in the motivations behind Islamization.

Book excerpt: Strategies on the Implementation of the Collection and Reporting of Fuel Oil Consumption Data Based an MARPOL Annex VI: A Malaysian Case Study Abstract Collection and reporting of ship fuel oil consumption data for ships of 5,000 gross tonnage (GT) and above have been made mandatory from calendar year 2019 onwards on an annual basis by the International Maritime Organization (IMO), which is one of the global standards under the Annex VI of the International Convention for the Prevention of Pollution from Ships (MARPOL). However, according to the IMO, not all potential 135 Administrations have submitted their data. Since Malaysia is amongst the active Administrations who have submitted the data, it is used as the case study to gauge the implementation of the collection and reporting of this fuel oil consumption data from ships. Thus, based on Malaysia's current implementation and challenges faced throughout the implementation, this study aims to propose strategies in ensuring that the implementation of the collection and reporting of ship fuel oil consumption data by other Administrations is in conjunction with the IMO convention. The implementation was made under the Merchant Shipping Ordinance 1952 (MSO52) through the issuance of Malaysia Shipping Notice (MSN). Recognised Organisations (ROs) were appointed and authorised on behalf of the government of Malaysia to collect, verify, and report the required data to the IMO. The findings of this study suggest that the MARPOL Annex VI should be incorporated into the National Laws, ROs should be appointed for collection and reporting of ship fuel oil consumption data, and clear methodology should be established on collection and reporting of ship fuel oil consumption data. Hence, there is an urgent need for Malaysia to strengthen its implementation and enforcement on the provisions of MARPOL Annex VI. There is also a necessity to monitor the performance of Malaysia’s shipping carbon emission and its contribution in reducing the total annual greenhouse gas (GHG) emissions set by the IMO by 2050.
